A hotel staff member working at a luxury five-star resort in Miami is being sued for allegedly storming into a guest's locked room to stare at her naked while she was in the shower.
The 48-year-old alleged victim, identified as C.N., was on a weekend getaway with her boyfriend at the St. Regis Bal Harbour Resort on December 11, 2023, when the terrifying incident unfolded, a lawsuit states.
Last week, C.N.' s attorney filed a civil lawsuit in Miami-Dade County against Marriott International and Clearview Building Services, LLC - a firm that provides cleaning and maintenance - alleging gross negligence, invasion of privacy and obstruction of justice, and is suing in excess of $7 million in damages.Â
The woman claimed in the lawsuit that the employee even brushed up against her nude body as he fled the room while she was screaming.
She also made a horrifying accusation in her filing: that supervisors at the luxury resort told her not to call the police.Â
Describing the alleged encounter, the woman says she decided to take a shower before she met her partner at the lavish resort's swimming pool.
She claims that as she stood under the running water, she suddenly felt a draft and heard the shower door bang.
She claims that when she turned, she saw the man, dressed in a shirt with a St. Regis logo, gawking at her.

'I was screaming hysterically - screaming at the top of my lungs,' she told the Daily Mail of the allegations.Â
'I didn't know what was going to happen next. Just the way he was looking at me up and down like a sicko,' she says about the alleged encounter.Â
The man then allegedly ignored her repeated requests to leave and walked further into the suite.Â
C.N. said she kept screaming, hoping someone would hear her cries for help until he eventually fled.Â
Shaken and traumatized by the alleged ordeal, she immediately called her boyfriend and hotel security, but was shocked by what she described as a lack of help.
C.N. said after that incident, she waited for about an hour for a supervisor who told her not to contact the authorities.
'They told us they have such a great relationship with the Bal Harbour police and that I don’t need to call them and that they will handle everything,' she said.
According to the lawsuit, the alleged victim later discovered that hotel staff claimed she did not want to call the police.
She says the allegations are 'patently false,' as per the complaint.Â
'I waited 24 hours to call police. In that time they [hotel staff] made sure they had the room cleaned, so there was no effort to protect me - they were protecting the perpetrator,' she alleges.

Perplexed by the way the hotel handled the incident, she asked, 'Why would they clean the room if they really wanted to know who did it? Or, are they protecting their own?'
She also asked the staff if she could see photos of the employees who were on duty at the time hoping to identify the alleged culprit, but claims staff denied her request.
'I was crystal clear on his face and it would have been easy to identify that person but they told me I could not see any photos without a subpoena - they really did not try,' she claims. 'They basically ignored me and there was no apology.'
The complaint, which has been reviewed by the Daily Mail, states that 'the Resort’s management had no intention of contacting law enforcement when they promised C.N. they would do so.
'Instead, they spent that critical 24-hour period obstructing any investigation and allowing critical evidence to disappear in their effort to prioritize their own interests.
'The resort’s management committed a gross violation of C.N.’s trust in their conspiracy to cover up this incident. This contributed substantially to C.N.’s emotional injuries, as confirmed by C.N.’s psychiatrists and mental health counselors.'

Justin Shapiro, who is representing the plaintiff, cited the St. Regis Bal Harbour Resort as having 'a complete and utter lack of supervision of its operations.'
'We have a whole lot of cases like this over the years and when we see this happen there is almost always a very distinct pattern of neglect on the part of the hotel,' he told Daily Mail.
He pointed out the lack of supervision of employees - claiming that there was no oversight, no monitoring and no tracking of the room access logs. Â
'These employees, who are often not background checked and just bad eggs, feel emboldened by the lack of supervision and see it as an opportunity to prey on the guests - whether it is theft of personal property, when they pop into the rooms or incidents like this sexual assault and invasion of privacy.'
According to court documents, the plaintiff continues to suffer from severe psychological distress requiring ongoing medical care.Â
C.N. had one more day left of her vacation after the alleged incident occurred.
Instead of leaving, she and her partner decided to stay.Â
'They asked us if we wanted to change rooms, and I wanted to get out of the room so they moved us to a larger suite and then they charged us for it,' she claimed.
The hotel employee has not been named and it's unclear if they are still employed.
'They are not telling us a word and we don’t have a legal right to know anything until we are in discovery and have subpoena power by the court,' Shapiro said.
'A large part of our claim is how our client was treated after this traumatizing incident,' he added.
'You would think the hotel would be there to protect her and comfort her but it was the exact opposite.'
The St. Regis Bal Harbour Resort, formerly owned by Starwood Hotels & Resorts Worldwide, Inc., was acquired by Quatar-based Al Faisal Holding Company LLC in 2014 and is part of Marriott Hotel International property group.

Neither representatives for Marriott nor Clearview Building Services, LLC returned the Daily Mail's request for comment.
