A Black former McDonald's employee, identified only by her initials, is pursuing a lawsuit against Cullen Management LLC, a McDonald's franchisee, alleging race discrimination, retaliation, and a hostile work environment. The lawsuit stems from the employee's termination following her wearing a Black Lives Matter face mask during the pandemic and the alleged failure of managers to protect her from racial slurs.
The US District Court for the Western District of Virginia ruled that the employee's claims against Cullen Management LLC can proceed. The court found sufficient evidence to suggest the franchisee treated Black employees differently and terminated her due to her race. However, the court dismissed the claims against McDonald's USA LLC, the franchisor.
